Protecting the Safety of Industrial Workers
Dubai, UAE, June 29, 2015 – DuPont Protection Technologies (DuPont) announced the signing of settlement agreements in two counterfeit cases involving fake DuPont™ Nomex® protective apparel supplied to the Oil & Gas industry in Southeast Asia and Central Europe. The infringement of the DuPont trademark and mislabeling of protective apparel jeopardized the safety of industrial workers in the regions.
“The successful settlement of these cases should serve as warning to those companies who abuse the law and misrepresent products they market,” said Marc Doyle, president DuPont Protection Technologies. “We will aggressively pursue cases of trademark infringement to ensure that no one is harmed by counterfeit protective apparel that does not meet important standards for safety.”
Safety Depot (PT DTS Nusantara) – Safety Depot of Indonesia admitted to having sold counterfeit products through their Safety Depot outlets serving the Oil & Gas industry that infringed on DuPont trademarks, including DuPont™ Nomex® protective apparel. Under the settlement signed on June 1, 2015, Safety Depot was forced to cease all use of the DuPont brands, remove all labeling from existing inventory, and issue a public apology, which has been completed.
DeLUX (SM, S.R.O.) and ASTONA (SM and Lubomír Mlček) – In this case, brought against a manufacturer of protective apparel in Slovakia, garments sold to the Oil & Gas industry marked with a “NOME” label and claiming to be composed of 93 percent Nomex® fiber were tested and discovered to contain no Nomex®. The settlement, signed on March 20, 2015, included an order for DeLUX and ASTONA to cease and refrain from using their NOME mark due to the confusing similarity to the DuPont™ Nomex® brand. In addition, the companies committed to cease all infringing use of the DuPont™ Nomex® brand, and remove and destroy all misleading labels.
Financial terms of the settlements were not disclosed. To ensure a product is authentic DuPont™ Nomex® brand fiber, purchasers are encouraged to verify that the supplier is a DuPont authorized customer or licensee.

"دوبونت" تتصدى لمقلّدي ملابس الحماية "نومكس" ممن يبيعون منتجاتهم لقطاع النفط والغاز
الإمارات، 29 يونيو 2015 - أعلنت "دوبونت لتقنيات الحماية" (DuPont Protection Technologies) اليوم عن توقيعها إتفاقيات تسوية في قضيتي تقليد متعلقتان بملابس الحماية "دوبونت نومكس" (DuPont™ Nomex®) الموردة لقطاع النفط والغاز في جنوب شرق آسيا ووسط أوروبا، حيث تسعى الشركة إلى منع تكرار مثل هذا الانتهاك لعلامتها التجارية واستغلالها بطريقة غير صحيحة حرصاً منها على سلامة العمال الصناعيين في تلك المناطق وعدم تعريضهم للخطر.
وقال مارك دويل، رئيس شركة "دوبونت لتقنيات الحماية": "يشكل نجاح إتفاقيات التسوية في هذه القضايا تحذيراً للشركات التي تنتهك القانون وتتسبب بالإضرار بسمعة المنتجات التي تقوم بتسويقها. وسوف نعمل بشكل حثيث على متابعة قضايا تقليد علامتنا التجارية من أجل ضمان عدم تضرر أي أحد جراء استخدام ملابس الحماية المقلدة والتي لا تلبي معايير السلامة".
"سيفتي ديبوت (بي. تي دي. تي. أس نوسانتارا)" (Safety Depot (PT DTS Nusantara))- اعترفت شركة "سيفتي ديبوت" الإندونيسية ببيعها منتجات مقلدة عبر منافذها التجارية التي تقدم خدماتها لقطاع النفط والغاز والتي قامت بانتهاك العلامات التجارية لشركة "دوبونت"، بما في ذلك ملابس الحماية "دوبونت نومكس". وبموجب اتفاقية التسوية الموقعة بتاريخ 1 يونيو/حزيران الجاري، تم إجبار "سيفتي ديبوت" على وقف استخدام كافة العلامات التجارية التابعة لـ "دوبونت" وإزالة كافة ملصقات هذه العلامات من مخزونها الحالي، بالإضافة إلى إصدار اعتذار رسمي، وهو ما تم بالفعل.
"ديلوكس (أس. أم، أس. آر. أو.) وأستونا (أس. أم. ولوبومير ملتشيك) (DeLUX (SM, S.R.O.) and ASTONA (SM snd Lubomir Mlcek))- تدور هذه القضية، المرفوعة ضد شركة مصنعة لألبسة الحماية في سلوفاكيا، حول ملابس تم بيعها لقطاع النفط والغاز موسومة بعلامة "أن. أو. أم. إي" (NOME) وتدعي باحتوائها على نسبة 93% من نسيج "نومكس"، وعند فحصها تبين أنها لا تحتوي على مادة "نومكس" مطلقاً. وتضمنت اتفاقية التسوية الموقعة بتاريخ 20 مارس/آذار الماضي أمراً موجهاً لشركتي "ديلوكس" و"أستونا" بوقف والإمتناع عن استخدام العلامة التجارية "أن. أو. أم. إي" نظراً للتشابه الكبير مع العلامة التجارية "دوبونت نومكس". كما التزمت الشركتان بوقف كافة أشكال الانتهاك للعلامة التجارية "دوبونت نومكس"، وإزالة وإتلاف جميع العلامات التجارية المُضللة.
هذا ولم يتم الكشف عن الشروط المالية في إتفاقيات التسوية. كما تم تشجيع المشترين على التحقق من أن المورد هو عميل أو جهة مرخص لها من قبل "دوبونت" وذلك من أجل ضمان الحصول على المنتجات الأصلية للعلامة التجارية "دوبونت نومكس".
ويتم إستخدام نسيج "دوبونت نومكس" للعزل الحراري حول العالم منذ عقود، حيث يعتمد العمال في قطاعات التصنيع والكيماويات والنفط والغاز وكذلك فرق الإسعاف في حالات الطوارئ وأفراد القوات المسلحة على الحماية التي يوفرها هذا النسيج من أجل تأمين سلامتهم. وبفضل نسيج "نومكس" تتمتع ملابس الحماية بأخف وزن وأعلى درجات الحماية، بالإضافة إلى التهوية لتخفيض الإجهاد الحراري فضلاً عن القدرة العالية على التخلص من الرطوبة. وبالإضافة إلى استخدامه لأغراض الحماية الشخصية، يتم إستعمال نسيج "نومكس" أيضاً في أنظمة النقل الجماعي وتوليد الطاقة من الرياح والمحولات وأجهزة الفلترة والخراطيم والطائرات.
